Arrangements

Prior to Mediation:

Once a mediation date has been agreed, the parties should:

  • Agree a venue
  • Prepare a bundle of agreed documents
  • Agree to a timetable for the exchange of position papers
  • Ensure that an authorized person will be present at the mediation, so that a final binding agreement can be entered into at the time of mediation
  • Prepare draft settlement documentation to enable timely finalization of documents if settlement occurs

Preliminary Conference:

I am happy for a preliminary conference to be arranged if there is any disagreement or complexity requiring directions, but in most circumstances anticipate agreeing preparatory matters via exchange of emails.

Fees:

Fees are exclusive of GST and are paid by way of a daily fee, which shall include up to 8 hours on the day of the mediation and up to 2 hours spent reading agreed bundle/position papers and holding any preliminary conference, if applicable. Any additional reading shall be billed at an hourly rate.
A cancellation fee of 50% shall apply for cancellation within 14 days of the specified mediation date, but shall not be payable if I obtain another booking for that date.
